This is Vaco’s privacy policy (“Privacy Policy”) which applies to all of the online services’ locations (e.g., our vaco.net website or the Vaco mobile app) (collectively, the “Site”), as well as each of the features, widgets, plug-ins, applications, content, downloads and other services (collectively, the “Service”) that are made available by Vaco, Inc. which operates as Vaco Communications (referenced hereafter as either “Vaco”, “we” “our” or “us”).
Vaco Communications is a private company that is organized and established in the U.S.A., having its address at 146 N. San Fernando Blvd., Suite 202, Burbank, CA 91502, United States.
This is Vaco’s Privacy Policy which sets out how Vaco will process any personal information or usage information that we collect from you, or that you provide to us, in connection with your use of the Site and Service, regardless of how or the way you access or use them. Please carefully read this Privacy Policy so you understand your rights in relation to your personal data and how Vaco will collect, use and process your personal information.
This Privacy Policy does not apply to data collection activities that occur outside of your use of our Service (unless otherwise stated below), and this Privacy Policy does not govern the data practices of third-parties that interact with our Service.
To the extent Vaco provides you notice on our Service of different or additional privacy policies or practices (e.g., at the point of our collection), those additional terms shall govern such data collection and use.
In addition, please review Vaco’s Terms of Service, which governs your use of the Service. By using our Service, you acknowledge that you have read and understood our Privacy Policy and Terms of Service and accept our collection, use and disclosure of your information and data, and other activities, as described below. We use various methods and technologies to store or collect Usage Information (“Tracking Technologies”). You acknowledge that you will incur a charge for these messages and calls by your telephone carrier and that Vaco is not responsible for these charges. Vaco has implemented STIR/SHAKEN in our network. We’ve established interoperability with major carriers and other enhancements that will support our customers’ compliance with STIR/SHAKEN. In addition, Vaco uses propriety methods to identify call spoofing and inbound traffic pumping with look up tables of Carrier Name and line type.

Vaco Communications, with its offices at 146 N. San Fernando Blvd., Suite 202, Burbank, CA 91502, United States, has created this Acceptable Use Policy ("AUP") to provide good service to our customers and to ensure the security and privacy of the services that Vaco provides to its customers (the “Vaco Services”). By using the Vaco Services, Vaco’s customers acknowledge and agree to the terms of this AUP. The terms of the AUP may be updated by Vaco in the future and the customer should stay acquainted with the most recent version of the AUP posted by Vaco to its customers. If you do not agree to the terms of the AUP, the customer must immediately cease any use of the Vaco services.
USE OF THE VACO SERVICES. The customer is responsible for any misuse of the Vaco Services that occurs through use of the customer's account, whether authorized by the customer or through an unauthorized third-party. Customer is responsible for the e-mail address and all of the contact information associated with the customer's account. Customer must ensure that unauthorized third parties do not gain access to the Vaco Services using the customer’s account. Customer is responsible for the security of any device the customer chooses to connect to the Vaco Services.
PROHIBITED ACTIVITIES. Any use of the Vaco Services which may violate Vaco’s network security is strictly prohibited. These violations may include the following:
NO ILLEGAL OR FRAUDULENT USE. The Vaco Services may only be used for lawful purposes. Customer will not use or allow others to use the Vaco Services in any manner that is in violation of any applicable federal, state, local or international laws, rules or regulations. Customer will not use the Vaco Services to promote or engage in any illegal activity that violates or infringes upon the rights of any person. The transmission of any communication using the Vaco Services in violation of any applicable law or regulation is strictly prohibited. This prohibition includes any material that is protected by copyright, trademark or other intellectual property right that is used without authorization.
NO UNSOLICITED COMMUNICATIONS. No user of the Vaco Services may send unsolicited bulk email or any type of electronic communication including any other type of communication that the recipient did not directly request from the sender. All messaging Vaco Services must comply with the Federal, State, and Local law.
In particular, users of the Vaco Services may not send any type of communication to any individual who has indicated that he/she does not wish to receive messages from them. Continuing to send messages to anyone that has expressly requested not to receive messages from a user is considered to be harassment. The customer is always responsible for maintaining confirmed opt-in records and must provide them to Vaco upon request. The term "opt-in" means that recipient has expressly signed up to receive such communications from the user voluntarily.
NO SYSTEM INTERFERENCE. The customer will not use, or allow others to use or access the Vaco Service to disrupt, interfere, degrade, or otherwise adversely affect Vaco’s network or equipment used to provide the Vaco Services.
SECURITY. The customer is responsible for the security of any device that the customer uses to connect to the Vaco Services. The customer must take all steps necessary to avoid actions that result in causing an issue or an abuse to the network that provides the Vaco Services. On notification from Vaco to the customer, the customer is required to address any such problem promptly and effectively. The customer’s failure to address an issue after notification from Vaco will be considered a violation of this AUP.
NETWORK. Vaco uses reasonable network management practices consistent with industry standards to ensure that its customers have a quality experience using the Vaco Services. Vaco monitors its network and attempts to address projected demand for capacity, taking reasonable steps to expand capacity, as necessary.
VIRUSES. Vaco customers must take appropriate action to prevent their devices from becoming infected with and/or distributing computer viruses such as but not limited to worms, "Trojan horses", denial of service attacks bots. Vaco will take appropriate action to address issues with parties using devices infected with computer viruses or worms to prevent further spread.
LEGAL ENFORCEMENT. Vaco reserves the exclusive right to investigate any violations of this AUP. In the event Vaco determines that a customer or any other user has violated the AUP, Vaco will take any responsive action that is deemed appropriate without prior notification. Such action may include: suspension of service, service restrictions, and the termination of services. Further, Vaco may take any other legal or technical action it deems appropriate.
NO WAIVER. The failure by Vaco to enforce any provision of this AUP shall not serve as a waiver of any right for Vaco to do so at any future time thereafter.
REVISIONS TO THE AUP. Vaco maintains the right to update and/or modify the AUP at any time with or without prior notice to its customers or other users. A party’s continued use of the Vaco Services is deemed the customer’s or other user’s acknowledgment and acceptance of the terms of this AUP. Customers should regularly review this AUP to ensure that their activities conform to the most recent version. In the event of a conflict between any customer agreement and this AUP, the terms of this AUP will always govern.
VACO RESERVES THE RIGHT, AT ITS SOLE DISCRETION TO IMMEDIATELY SUSPEND, TERMINATE, OR RESTRICT A PARTY’S USE OF THE VACO SERVICES WITHOUT NOTICE IF SUCH USE VIOLATES THIS AUP.

Certain features of the Service permit you to initiate interactions between the Service and third-party services or platforms, such as social networks (“Social Features”). Social Features include features that allow you to click and access the Company’s pages on certain third-party platforms, such as Facebook and Twitter, and from there to “like” or “share” our content on those platforms. Use of Social Features may entail a third party’s collection and/or use of your data. If you use Social Features or similar third-party services, information you post or otherwise make accessible may be publicly displayed by the third-party service you are using. Both the Company and the third party may have access to information about you and your use of both the Services and the third-party service. When you are on the Service, you may be directed to other sites and apps that are operated and controlled by third-parties that Vaco does not control, such as merchants who directly sell products and services to you (“Third-Party Owners”). If you go to these other sites and apps, such sites and apps will have their own privacy policies. We are not responsible for these third-party privacy policies or the practices of Third-Party Owners. Be sure to review any available policies before submitting any personally identifiable information to a third-party application or otherwise interacting with it and exercise caution in connection with these applications and Third-Party Owners.

Vaco collects certain “Personal Information” as defined by the California Consumer Privacy Act 2018 (“CCPA”). In the past 12 months, we have collected such Personal Information described in Section I above, from the categories of sources listed in Section I.
Vaco does not sell such Personal Information about you to third parties and Vaco has not done so in the past 12 months. However, we share certain such Personal Information with the third parties, and for the purposes, described in Sections III and IV above.
If you are a California resident, subject to applicable law and verification, you may have the following rights in relation to such Personal Information subject to the CCPA.

Right to Delete: You may request that Vaco delete any Personal Information we have collected from you.
Vaco does not discriminate against you based on you exercising any of the above rights.
If you are a California resident you may also request certain information about our disclosure of information about you to third parties for their own direct marketing purposes during the preceding calendar year. This request is free and can be made once a year by contacting us as described below.
If you are a member under 18 years of age, and a California resident, you have the right to request removal of unwanted information that you publicly post on our Website. To request removal of such information, please contact us as described below. Upon receiving such a request, we will make sure that the information is not publicly available on our website, but the information may not be completely or comprehensively removed from our systems and databases.

We will need to verify your identity before processing your request, and you must include your full name, email address, and a current California address in your request. Under the CCPA, you may designate an authorized agent to make requests on your behalf. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

You are responsible for maintaining the accuracy of the information you submit to Vaco, such as your contact information provided as part of registration. The Service allows you to review, correct or update Personal Information you have provided through the Service’s registration forms or otherwise by updating your Service account, and you can provide registration updates and changes by contacting us by email at: [email protected]. If so, we will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable (but we retain prior information for business records purposes). Please note that it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons. When you edit your Personal Information or change your preferences on the Service, information that you remove will persist internally for Vaco’s administrative purposes. As described above in Section II.(2), you may opt-out of receiving text messages by texting STOP to any text message or CLICK HERE. You may also change your “Notification” settings in your profile. To opt-out of receiving phone calls (but not text messages), please CLICK HERE. You can cancel or modify our email marketing communications you receive from us at any time by following the instructions contained within our promotional emails. This will not affect subsequent subscriptions and if your opt-out is limited to certain types of emails the opt-out will be so limited. Please note that we reserve the right to send you certain communications relating to your account or use of our Service, such as administrative and Service announcements and these transactional account messages will be unaffected if you choose to opt-out from receiving our marketing communications.

Vaco will retain your information for as long as we are required in order to provide the Service to you, as required to fulfil our legal requirements and defend legal claims. After you have terminated your use of our services, we store your information in an aggregated and anonymized format.

Vaco’s Service is operated in the United States and intended for users located in the United States. If you are located outside of the United States, please be aware that information we collect, including Personal Information, will be transferred to, and processed, stored and used in the United States in order to provide the Service to you. We transfer personal data outside the European Economic Area (“EEA”) and UK as it is necessary in order for us to provide you with our Services per our Terms of Services.
Access, Rectification and Portability: You have the right to ask Vaco to access the personal data we hold about you and be provided with certain information about how we use your personal data and who we share it with. You also have the right to ask us to correct your personal data where it is inaccurate or incomplete. Where you have provided your personal data to us with your consent, you have the right to ask us for a copy of this data in a structured, machine readable format and to ask us to share (port) this data to another data controller.

This is without prejudice to your right to raise a complaint with a relevant supervisory authority.
Vaco will never knowingly collect or solicit personal information from children under the age of eighteen (18) or under the age of majority in their resident jurisdiction, or knowingly allow such persons to sign-up for the Service. Vaco and its Service are not directed at children under the age of eighteen (18) who are prohibited from accessing the Service. If you are a child under eighteen (18) years of age, or under the age of majority in your resident jurisdiction you are not permitted to use the Service and you should not send Vaco any information about yourself to us or to anyone else through the Service. In the event Vaco becomes aware that we have collected personal information from any child under the age of eighteen (18), we will dispose of that information as quickly as possible.
